These Terms & Conditions (“Terms”) govern your access to and use of the Power Paws website, shop, content, and services (the “Site” and “Services”). The Site is operated by Sunshine Commerce Pty Ltd (ABN 46691645299), “Power Paws”, “we”, “us”, “our”).

By visiting the Site, creating an account, or purchasing our products (including subscriptions), you agree to these Terms and to our Privacy Policy and Refund/Returns & Shipping Policy (together, the “Policies”). If you do not agree, please do not use the Site.

You must be 18+ to purchase from us.

1) General Conditions

We provide the Site on an “as is” and “as available” basis and may change, suspend, or withdraw any part at any time.
We may refuse service, cancel orders, or terminate accounts for breach of these Terms or misuse of the Site.

2) Use of the Site & Intellectual Property

All text, graphics, product copy, photos, videos, logos, icons, and software on the Site (“Site Content”) are owned by or licensed to Power Paws and are protected by IP laws.
You may view and print pages for personal, non-commercial use only. No copying, resale, republication, scraping, framing, or derivative use without our written permission.
Nothing on the Site grants any licence to our trademarks or other IP.

3) Limited Licence

We grant you a revocable, non-exclusive, non-transferable licence to access the Site for personal use in accordance with these Terms.

4) Prohibited Uses

You must not:

Break the law or infringe any third-party rights using the Site.
Upload malicious code, spam, or content that is unlawful, defamatory, harassing, hateful, or obscene.
Attempt to gain unauthorised access to the Site or our systems.
Use bots, scrapers, or other automated tools to access or extract data from the Site.
Reverse engineer or modify any part of the Site.
Misrepresent your identity or affiliation with Power Paws.
Use our products for resale on marketplaces (e.g., Amazon/eBay) without written authorisation.

We may suspend or terminate access for any breach.

5) Accounts

You’re responsible for the accuracy of your account details, safeguarding your password, and all activity on your account.
Notify us promptly of any unauthorised use.

6) Product Information, Pricing & Availability

We try to keep product descriptions, pricing, and stock accurate, but errors can occur.
We may correct errors, update information, or cancel orders (with a refund) where information was inaccurate.

7) Purchases & Payments

When you place an order, you authorise us and our payment providers to take payment using your chosen method.
We may refuse or cancel any order (e.g., suspected fraud, address issues, stock errors).
Prices are in AUD unless stated otherwise and may change without notice.

8) Subscriptions

Subscriptions automatically renew at the stated interval until cancelled.
You can manage, pause, or cancel through your customer account or by contacting support before the next billing date.
Changes made after a renewal may apply to the following cycle.
Promotional offers don’t always apply to active subscriptions unless specifically stated.

9) Shipping, Delivery & Risk

We currently ship across Australia (free) and to New Zealand (flat $15 AUD).
Delivery timeframes are estimates only. Risk in the goods passes on delivery to your address or collection point.

10) Returns, Refunds & Satisfaction

We offer a 30-day satisfaction guarantee on first-time purchases of DS-23. Conditions apply (e.g., one unit per household, proof of purchase).
Damaged or faulty items will be replaced or refunded in line with the Australian Consumer Law (ACL).

11) Promotions, Discounts & Gifts

Promotions/codes are single-use, non-transferable, cannot be combined unless stated, and may be changed or withdrawn at any time.
Giveaway terms (if any) will be published separately and will apply over these Terms where inconsistent.

12) Reviews, Comments & User Submissions

If you submit reviews, photos, or comments (“User Content”), you:
- confirm you own or control the rights;
- grant Power Paws a worldwide, royalty-free, perpetual licence to use, reproduce, edit, and display such content for marketing and operational purposes;
- agree not to submit unlawful, misleading, or infringing content.
We may moderate or remove User Content at our discretion.

13) Health & Safety Disclaimer (Not Veterinary Advice)

Information on the Site is general in nature and not a substitute for veterinary advice, diagnosis, or treatment.
Our products are dietary supplements for dogs, not medicines.
Always consult your veterinarian regarding your dog’s health, allergies, medications, or before starting any supplement—especially for puppies, pregnant/lactating dogs, or dogs with medical conditions.
Results vary by dog, diet, age, and consistency of use.

14) Third-Party Links & Services

The Site may link to third-party sites or services. We’re not responsible for their content, policies, or practices.

15) Warranties & Liability (Australia)

Nothing in these Terms excludes rights you have under the Australian Consumer Law.
To the maximum extent permitted by law, the Site and Services are provided “as is”, without warranties of any kind (express or implied).
Where goods or services are not of a kind ordinarily acquired for personal, domestic, or household use, our liability is limited, at our option, to:
- (for goods) replacement or repair of the goods or payment of the cost of doing so;
- (for services) resupply of the services or payment of the cost of resupply.
We are not liable for indirect, special, or consequential loss (including loss of profits or data) arising from your use of the Site or products, except to the extent such liability cannot be limited by law.

16) Indemnity

You indemnify Power Paws and our directors, employees, and contractors against losses arising from your breach of these Terms, misuse of the Site, infringement of third-party rights, or unlawful conduct.

17) Privacy

Personal information is handled in accordance with our Privacy Policy (AU Privacy Act and APPs). By using the Site, you consent to such handling.

18) Communications (Email/SMS)

With your consent, we may send order updates, shipping notifications, and marketing messages.
You can unsubscribe at any time (email unsubscribe link or reply STOP for SMS).
Message/data rates may apply. We comply with the Spam Act 2003 (Cth).

19) Governing Law & Disputes

These Terms are governed by the laws of Queensland, Australia. You submit to the exclusive jurisdiction of the courts of Queensland (and courts entitled to hear appeals from them).

We encourage you to contact us first so we can resolve any issue quickly.

20) Changes to These Terms

We may update these Terms from time to time by posting the new version on the Site. Your continued use constitutes acceptance of the updated Terms.
